TSC Decision

The Teachers Service Commission (TSC) has announced it will stop deducting the Burial Benevolent Fund (BBF) from the salaries of Kenya Union of Post Primary Education Teachers (KUPPET) members. This decision comes after a petition filed by several KUPPET branch executive secretaries.

 

 

 

 

 

 

 Petition and Evidence

On May 21, 2024, TSC’s Director for Legal and Industrial Relations, Anyuor Cavin, sent a letter to KUPPET Secretary General Akello Misori. The letter referenced a petition filed at the Employment and Labour Relations Court by five KUPPET branch executive secretaries. These secretaries are Paul Kipchumba Rotich, William Lengoiyap, Robert Miano, Peter Oluoch, and Jentrix Ogola.

 

The petition included Jentrix Ogola’s payslip as evidence to challenge the legality of the BBF deductions. The petition also called on the Ethics and Anti-Corruption Commission (EACC) to investigate TSC over these deductions.

 

 

 

 

 

 

 

 Background and Resolution

The BBF deductions were implemented following consultations during the KUPPET Annual Delegates Conference on April 3, 2024, with a resolution reference number KUPPET/TSC/015/021. However, KUPPET officials later sought to scrap these deductions, leading to the current decision by TSC.

 

 

 

 

 

 

 

 Reaction from Teachers

Teachers contributing to the BBF have often criticized the fund, arguing that it does not directly benefit them. Many teachers find the deductions discriminatory and unhelpful, as the money is used for funerals rather than providing support to living teachers.

 

 

 

 

 

 

Calls for Alternative Funds

During various campaigns, some KUPPET officials emphasized the need for a fund that would benefit teachers while they are still alive. They argued that contributions should support teachers’ immediate needs rather than funeral expenses.

In response to these concerns, TSC has now officially ended the BBF deductions for KUPPET members. This decision aligns with the wishes of many teachers and KUPPET officials, who have been advocating for a more beneficial and fair approach to fund deductions.
