Introduction:

As the retirement of Dr. Nancy Njeri Macharia, the Secretary and Chief Executive of the Teachers Service Commission (TSC), looms, attention turns to her successor. Dr. Macharia is expected to begin her terminal leave in March next year, leading to her official retirement in June 2025. Hence marking the beginning of a succession race.

Clarification on Retirement Timing:

Last year, the TSC clarified confusion surrounding Dr. Macharia’s retirement. TSC affirmed that, although she reached the mandatory retirement age of 60 under Public Commission laws, as a State officer, she is not bound by this rule. Mr. Cavin Anyuor, TSC Director of Legal, Labour, and Industrial Relations, highlighted that Dr. Macharia would fulfill her full 10-year term ending in 2025. This is as per the TSC Act and the Constitution.

Legal Reference and Career Background:

Anyuor cited the TSC Act of 2012 Section 16 (3) and Constitution Article 260t. He cited it to define Dr. Macharia’s status as a State officer. Born in 1963, Dr. Macharia has dedicated over 28 years to Kenya’s education sector, assuming her current role in May 2015 after a competitive recruitment process.
