The Kenya National Union of Teachers (Knut) vehemently opposes proposed amendments to the Teachers Service Commission (TSC) Act of 2012, asserting that these modifications are not only unfavorable but also punitive. According to Knut, the TSC failed to involve them in formulating the Bill, expressing discontent with a lack of consultation.
Concerns Over Lack of Consultation
Knut Secretary-General Collins Oyuu revealed that the union received a letter from TSC last week outlining the proposed amendments, expressing concern over the harmful impact on teachers. The draft Bill suggests restructuring the basic education system, omitting early childhood development and education (ECDE) from its scope.
Objection to Unilateral Remuneration Determination
One notable objection from Knut is the TSC’s intention to determine teachers’ remuneration without involving unions and seeking advice from the Salaries and Remuneration Commission (SRC). According to Mr. Oyuu, this violates Article 230 of the Constitution, emphasizing the need for consultation with relevant stakeholders.
Concerns Over Disciplinary Powers
Moreover, the proposed disciplinary powers of TSC, not bound by strict rules of evidence, raise concerns about potential misuse. Mr. Oyuu stressed the importance of due process in safeguarding educators’ rights, accusing TSC of lacking a clear stance on teachers’ pensions.

Proposal for Joint Committee
The draft Bill suggests establishing a Joint TSC-Knut committee to identify cases warranting review, addressing criticism of TSC’s disciplinary procedures. However, Mr. Oyuu criticized the lack of clarity in the proposal for new staffing norms, raising concerns about the reintroduction of punitive measures such as de-localization.
Boycott and Alternative Participation
Despite Knut’s decision to boycott the TSC-organized public participation exercise, the Kenya Union of Post Primary Education Teachers (Kuppet) confirmed their attendance. Kuppet Secretary-General Akello Misori mentioned that they would discuss amendments during the forum but did not provide specific details on their presentation. According to Misori, the draft Bill contains weighty issues that need careful consideration.
