  Introduction:
Education Principal Secretary Belio Kipsang, has instructed all schools to stop demanding payments beyond the authorized one. Kipsang emphasized that primary and junior schools, primarily day schools, have their tuition needs covered by capitation from the Ministry of Education.
In a circular dated February 2 , addressed to Regional and County Directors of Education. In the circular Kipsang stated unequivocally that public and junior schools should not impose any fees. He underscored the necessity for schools to complete the provided fees declaration form. The form must be endorsed by Sub County Directors of Education. The form must be submitted in both hard and soft copies to the Ministry headquarters by February 9 . The submission will be done via directorsecondary@education.go.ke.
To ensure compliance, Kipsang held Sub County and County Directors of Education responsible . He said that any breaches within their jurisdictions will be put into account. He reminded them of their obligation to adhere to the authorized fees structure outlined in Kenya Gazette notice No 1555 of March 2015, with payments distributed in the ratio of 50%, 30%, and 20% respectively.
Kipsang expressed regret over reports of unauthorized levies imposed by public primary, junior, and secondary schools. This comes despite the Ministry issuing circulars addressing the matter. He cited a circular from May 30, 2023,. The circular will ban school heads from selling or stocking uniforms and boarding items. He emphasized on the need for compliance across all learning institutions.
Kipsang reiterated that the Constitution mandates the Education Cabinet Secretary to implement free and compulsory basic education for all children of school-going age. He urged Regional Directors, County Directors, and Sub County Directors to promptly report any instances of school principals, boards of management, or head teachers charging unauthorized levies.
Conclusion:
Kipsang highlighted the optional nature of the lunch program in day schools, Kipsang emphasized that no child should be denied schooling for failure to pay for it. He urged County and Sub County Directors of Education to employ a multi-agency approach to ensure adherence to authorized fees structures and the effective implementation of free and compulsory basic education.
