      Introduction:

The Kenya Union of Post Primary Education Teachers (Kuppet) is urging a constitutional review to enhance inclusivity and establish democratic processes. Central to this initiative is expanding elective positions from 10 to 16, facilitating the representation of officials from historically marginalized regions such as Coast, North Eastern, and Nairobi at the national leadership level.

Background of the Constitution

An internal report obtained by reporters reveals that the current Kuppet constitution, enacted in 2010 when the union had 20,000 members, is now outdated. At that time, Kuppet’s presence was limited, resulting in only 10 delegates per branch during decision-making processes and elections. With Kuppet’s current membership exceeding 120,000, each delegate represents a significantly larger group, undermining democratic principles.

Call for Constitution Revision

Union officials assert that revising the constitution is essential to align with Article 41 of the Constitution of Kenya, granting all union members the right to participate in union affairs. The proposal emphasizes the dynamic nature of constitutions and the need for periodic updates to meet evolving organizational and societal needs.

Opposition and Clarifications

Despite the push for constitutional changes, some Kuppet board members oppose the review, suggesting it aims to create positions for allies and increase senior officer retirements. The union counters these claims, clarifying that retirement age is clearly defined in the current constitution and national legislation.

Addressing Concerns

The union’s document addresses concerns about resignation before contesting a different position, stating it aligns with democratic practices found in Kenyan laws. Union leaders, Secretary General Akello Misori, and National Chairman Omboko Milemba downplay opposition, highlighting Kuppet’s democratic nature and internal mechanisms for issue resolution.

Support for Constitutional Review

Supporting the constitutional review, the document emphasizes the goal of entrenching democracy in the union. It points out the exclusion of newly-registered branches, particularly in Coast and North Eastern regions, from mainstream union leadership, and the need for gender balance and representation of teachers with disabilities.

Teacher’s Demand for Representation

Last week, secondary school teachers demanded an expansion of representation in the national union, advocating for a constitutional review aligned with the Constitution of Kenya. This move aims to ensure equal representation for all counties and address gender parity and the inclusion of teachers with disabilities at the national level.

Regional Leaders’ Perspective

Leaders from various regions, including Coast, Kiambu, Kajiado, Nairobi, and Machakos, emphasize that constitutional review will provide a voice in decision-making for all teachers, breaking away from the historical dominance of a limited number of delegates.

In conclusion, the push for a constitutional review by Kuppet reflects the evolving landscape of the union, seeking to address historical imbalances and enhance democratic principles in its governance.
